1. Agreement to these Terms

These Terms of Service (“Terms”) are a legal agreement between you and Castilho Enterprises (“Muse,” “we,” “us,” or “our”) governing your use of the Muse mobile application, this website, and related services (together, the “Service”). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use Muse. If you are not old enough to enter a binding agreement where you live, your parent or legal guardian must review and accept these Terms for you.

2. What Muse does

Muse is an AI-assisted beauty visualization tool. It lets you submit a portrait and a reference image, choose hair, makeup, or both, and receive a generated visualization. Results are creative previews—not professional cosmetic, medical, dermatological, or hair-care advice, and not a guarantee that a physical treatment or product will look the same in real life.

We may add, change, suspend, or discontinue features. We aim to keep Muse available, but do not promise uninterrupted or error-free access. Device, internet, app-store, or provider limitations may affect the Service.

3. Accounts and security

Muse may begin with a private guest workspace. You can link an account through supported sign-in providers to protect your credits and saved looks. You are responsible for keeping your device and sign-in credentials secure and for activity under your account. Tell us promptly if you suspect unauthorized access.

Account information must be accurate. You may not sell, transfer, or share an account in a way that compromises security or evades purchase, credit, eligibility, or enforcement controls.

4. Your photos, prompts, and results

Your rights and permissions

You retain your rights in photos and other content you submit. You grant Muse a limited, worldwide, non-exclusive license to host, copy, process, transmit, modify, and display that content only as needed to operate, secure, and improve the Service and to follow your directions.

You confirm that you own or have permission to use every image you submit and that using it with Muse will not violate another person’s privacy, publicity, intellectual-property, or other rights. Do not submit another person’s face without their informed permission.

Generated results

As between you and Muse, and to the extent permitted by law, you may use results generated for you and we assign to you any rights we may have in those results. Your use remains subject to these Terms, applicable law, and third-party rights. AI-generated results may not be unique, and another user may receive similar content. Muse does not guarantee that a result is eligible for copyright or other intellectual-property protection.

5. Credits, subscriptions, and purchases

Some generations require credits. The required credit amount is shown before you generate. Credits are a limited, personal, revocable right to use eligible features; they are not money, property, or a stored-value account, and cannot be transferred or redeemed for cash except where law requires.

Subscriptions and credit packs are purchased through the Apple App Store or Google Play. Prices, taxes, billing periods, renewal terms, trials, and included benefits are shown at purchase. Subscriptions automatically renew unless you cancel through the store before renewal. Deleting the app or your Muse account does not cancel a store subscription.

The store’s payment and refund rules apply. We may correct credit balances affected by errors, refunds, chargebacks, abuse, or reversed transactions. Statutory consumer rights remain unaffected.

6. Acceptable use

You may not use Muse to:

• violate any law or another person’s rights;
• submit a person’s image without the permission required by law;
• impersonate, deceive, harass, exploit, defame, or harm anyone;
• create or distribute sexual content involving minors or any non-consensual intimate imagery;
• bypass safety, purchase, credit, access, or rate-limit controls;
• probe, disrupt, overload, scrape, reverse engineer, or introduce malicious code into the Service, except where a legal right cannot be restricted; or
• use results as proof of identity, as biometric authentication, or for high-impact decisions about another person.

We may investigate suspected misuse, remove content, limit generations, suspend access, or terminate an account when reasonably necessary to protect users, providers, or the Service.

7. Muse’s intellectual property

The Service—including its software, design, branding, text, curated inspiration, and technology—is owned by Muse or its licensors. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose under these Terms. No other rights are granted.

8. Account deletion and termination

You may stop using Muse at any time and can delete your account from Profile → Account. Account deletion is permanent and removes saved looks, generated images, generation history, credits, and account information as described in the Privacy Policy. A one-way eligibility marker may remain to prevent repeated welcome-credit claims.

We may suspend or terminate access for a serious or repeated breach, legal requirement, security risk, or threat to the Service. Where appropriate, we will provide notice and a chance to appeal by contacting support.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing. We do not guarantee that results will be accurate, photorealistic, unique, free of artifacts, or suitable for a particular purpose.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded, including mandatory consumer guarantees.

10. Limitation of liability

To the maximum extent permitted by law, Muse and its owners, affiliates, providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of US$100 or the amount you paid Muse during the 12 months before the event giving rise to the claim.

These limits do not apply where prohibited, including liability that cannot be limited for fraud, willful misconduct, death, personal injury, or mandatory consumer rights.

11. App-store terms

If you download Muse from Apple or Google, that store’s terms also apply. The store is not responsible for Muse or its content except as its terms require. For Apple downloads, Apple’s Standard Licensed Application End User License Agreement also applies.

12. Governing law and disputes

These Terms are governed by the laws applicable to Castilho Enterprises, without regard to conflict-of-law rules. Mandatory consumer protections in the place where you live remain available to you. Before filing a claim, you and Muse agree to try to resolve the issue informally by email for at least 30 days, unless urgent relief or applicable law makes that inappropriate.

13. Changes and general terms

We may update these Terms as Muse evolves. We will post the new version and effective date and provide additional notice for material changes where required. Continued use after the updated Terms take effect means you accept them.

If part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, or sale of the Service.
